Divorce applications should be moved online, says lawyer

A divorce lawyer says applications should be made online because traditional family court procedures are outdated and expensive

 

Catherine Thomas, managing director of specialist family law firm Vardags, has complained of form-filling in triplicate and says estranged couples get a poor service.

She suggested change after the most senior family court judge in England and Wales said plans for online divorce were at a stage where they could ”move forward much further”

“The current procedure for applying for a divorce is outdated, inconvenient and expensive,” said Ms Thomas on Thursday.

“Everything has to be done on paper, in triplicate, on forms which can be very daunting for litigants in person.”

“The slow bureaucracy of our family courts produces poor value for the taxpayer.

“A move online would streamline this immensely.”

Sir James Munby, the President of the Family Division of the High Court, has suggested that online divorce is moving nearer in a regular review of legal issues he writes for lawyers.

He also said the process of divorce should be separated from disputes about money.
