I am a father to a wonderful 6 year old. Last year I won a court order that gave me the right for my son to stay with me at regular intervals.
Fast forward to lock down.
My wife's parents are disabled and require daily help from a live in carer and my wife.
There is necessary visits between my household and my parents in law but I must stress that both households are in lockdown. and have been for 4 weeks.
My position: (My son should be able to stay with me as per order)
It is clear from the cafcass website, and official government guidelines state that children under 18 that are subject to a shared custody order should adhere too it.
X's Position (Reason for not allowing my son to my home)
She does not believe we are fully locked down and feels it is an unsafe environment for him because my wife goes to her mothers to asist her daily -
With all three households in lockdown, I feel its safe for my son to stay with me. and I want to engage my lawyers to take action. - before i do this I wonder if anyone else is having a similar issue and could provide their point of view?
i have been going through similar. ex decided not to let me see kids because of lockdown. very hostile. its been over 3 weeks where i have not had any contact with the kids. she will allow video calling this weekend, only after i bugged her family members and cafcass about it.
so if your ex won't let you see your child, then she needs to allow video calls. if she doesn't do that, then you should take it to court. am just hoping school's re-open before summer holidays...
