Hi all, hopefully someone can offer advice or experience on the following.

I have just been made redundant and been given a good package (as had been with the company for many years); is my ex partner able to make a legal claim against this money at all?

As far as I see it, the first 30k is tax free, so, she wont get that in the next tax year, but, prob the CMS will assess me next tax cycle from the residue, am guessing.

But, is there any other way that she can claim against me, legally?

I have informed the CMS and stated that have registered for job seekers allowance and they are adjusting accordingly.

Any advice is very much appreciated :-)

The residue above £30k will end up your tax return for this year, and you will be assessed on this accordingly when the time comes when this figure is used. If your current salary is within 25% of this then you will not be able to adjust.

CMS use taxable income, and the first £30k is tax free so this will not count and will not be passed to the HMRC.
