Im about to lose it. I recently received a letter from CMS asking for wage slips from my new job and after this and that I was spoken to rather rudely about not informing them of job changes since 2016. I have letter after letter stating because of my income and expences i was on a nil rate and now im being told that actually i will have a massive ammount oweing. They have always had real time access to my wages. I support 3 children and have to maintain car to travel to work and etc and now the calculation says i have to pay £193 a month which means i would t be able to afford to work. Ive had no contact with the other oarent who has told the world including the child that Im dead. And now I will be charged an extra 20% if payments are made thru the CMS? I cannot afford to work to support my family and pay for a child that I’ve been told over n over again “I’m nothing to do with her” and her mother wants nothing to do with or want nothing from me! Im at my wits and and ready to give up all hope.
£193 a month is pretty low. about CMS, if you refuse to pay anything, they can do enforcement payments, where they take from your account and charge 20% on top of each payment. you can volunteer to do direct pay, where you pay your ex yourself, directly paying into her account every month, and theres no extra charges. i am guessing you told CMS that you support 3 children? as they should reduce your payments because of that.
child support laws state that you have to pay maintenance, even if your not seeing the child.
Ive told them about the 3 children in the house, but its made no real difference. What I have a problem with is my ex who wont engage at all in any way. I can barely support my family on what i earn now and £193 a month would put my family in constant debt. So what do I do then when paying for a child that Ive been told to forget , and which i have in writing from her mother, means I cannot support my family? I feel as though I’m being scape goated and taken advantage of
She has a habit of not following through so what would happen if she chooses to not engage with CMS? Case in point, she started divorce proceedings and then then ignored it so i had to wait for five years to finish it properly.
