I had a child arrangement order with my ex for our daughter however in December 2017 she had a few issues so rather than go to court we agreed 50/50 split custody. During 2018/19 we tried several times to reconcile our relationship but it just did not work. She had several relationships and after one with a previous partner she put our daughter and her 2 sisters at risk so myself and the other dad were about to go to social services when the mother reported us for alleged stalking and harassment. She also told the child maintenance service that we only had our daughters once a week. However the actual contact stayed the same exactly 50%. After 24 weeks the police told me that there was no evidence and they had my phone for the same amount of time which I had to pay £300 in phone charges for a phone I could not use. The child maintenance service treated me like a criminal and would not believe me when I told them my actual contact even though I supplied them with evidence including a letter from the previous local child protection police officer who was a friend of my family. I have had to pay to go to court to get a new child arrangement order which shows the actual contact that I have had since December 2017 and I now am awaiting a HMRC appeal tribunal to prove my case early next year. The CMS have expected me to pay my ex partner weekly which I have not and then if my appeal is successful claim the money back from her. She did this out of spite and has done the same to the other father it is nothing but lies. How much as this process cost the DWP and surely she can be charged with an offence as the financial cost to the DWP, myself and also the stress to myself and my family as well as too the other father. Why are fathers not treated equal?
Unfortunately, there isn't anything in the system for DWP to recover monies where one side has been lying. It would be good if there was a financial penalty built in, and also for the courts, but can't see this happening. It is madness about how much it costs the taxpayer.
