Hoping someone can give me some advice
My daughter was in full time education but this stopped in February. She turned 18 in April this year however the CMS say I still have to pay maintenance to her mother and a review has just arrived with payments for the next year ? Do I need to continue to pay even though her education finished in feb ? The cms say that whilst child benefit is still being claimed I still have to pay

She’s no longer in education and works part time

it may be that CMS have not bothered to check the child benefit status. could ask them to check and confirm.

Apparently the child benefit gets paid until September does this mean I pay until then and then it stops ?

yes, from what i have read, if a child e.g. finishes full time education in july, then you are expected to pay maintenance until september of same year.

Ok just had a very confusing convo with cms who said I had to pay until she was 20 ?! Even though she was not in education

sounds odd. from what i read, it goes up to 20 if child is doing a-levels, full-time education. might be worth putting a complaint in.

I agree - put a complaint in. I would say that if education stopped in February, then really you should have stopped paying after this month.

i heard that in these situations, CMS just takes the word from receiving parent. so they could be just lying and telling CMS that child is still in full-time/approved eduation. and CMS/DWP will not be checking if a child is still in education or not.

Yes it seems that way apparently it all depends on child benefit being paid .... so if full time education finished in feb when would the child benefit end ? Also if I put a complaint in do I continue to pay the maintenance? Or would they refund any over payment ??

i heard asking for refund is very difficult and your unlikely to get. can try. if CMS say you have to continue to pay maintenance, then its better to pay. otherwise they will give you more headache, about arrears/enforcement action.

Child Benefit when your child turns 16

Your Child Benefit stops on 31 August on or after your child’s 16th birthday if they leave education or training. It continues if they stay in approved education or training, but you must tell the Child Benefit Office.

You’ll be sent a letter in your child’s last year at school asking you to confirm their plans.
