Just as you think things are on an even keel, CMS surprises again!! Hoping someone may have had same and had a positive result/appeal.

So today I have a letter increasing my CMS by £100 due to my ex informing CMS that I am not meeting my shared care overnight obligations of 52 nights per year. Any change has been due to Covid and their website says changes will not be considered for this reason currently. Yet, they have made the new award, without any consultation with me, nor considering their own statement.

It is irrelevant given the above, but my ex is exposed to Covid daily, refuses to discuss her situation and how she mitigates the risk, but still expected me to have my child during lockdown. I was able to meet my child safely, twice a week for walks and bike rides, so I was still seeing her and she has been totally happy with the situation. To add, I have an at risk person in my house.

I have just confirmed taking her camping next week and other overnight obligations and this comes in and makes all of that tainted.

Any advice.

hi,

do you have a court order in place? CMS should not have made the changes to shared care over covid period. All i can suggest is ring CMS back and complain.
