Hey all,

So I've been paying for my two sons for the last year, 3 and 2. Been helping my friend get through the details of everything as they don't know what to do. I'm a little confused as I cannot find anything on the Internet.

So I provide the ex with money for both sons I have them every weekend and I make sure my sons have everything they need nappies wipes food clothes etc.

My friend how ever is stuck as there ex gives him money due to him having full custody of there daughter. His ex how ever has said that CSA has told her that she has to give him ex amount of money to help him, and he has to supply her with nappies wipes food and clothes for when she has her daughter. She has her 2 nights a month.

Now I've never demanded items from there mother to help me when I have them surely the money given is to go towards the child when in the care of the main carer parent and not to provide the other parent with supplies?

hi,

if maintenance is paid through a private arrangement then basically anything goes. both parents can come to agreement. but it seems that often there is bickering about money, then one goes to open a claim with CMS.

if your friends ex is paying him through CMS, then he uses that money to maintain the kids while he has them. he does not have to provide any supplies to his ex when the kids are staying over there. his ex is responsible for any costs when the kids are staying with her. this is why CMS gives the paying parent a discount based on the number of nights the kids stay with him/her.

This is far too complex so I'm going to make it simple

1.Parent not living with children most of the time pays main carer maintenance based on amount of overnights and income.

2.Both parents have separate lives and must pay for anything that happens in "their time"

3.Neither has to provide anything to other ex

The fact your friend is resident parents says it all. No he does not have to provide nappies and wipes or anything else just because she is having child. Whilst in her care its her responsibility to provide nappies and make sure she has dinner and drinks etc
