So my partner was in court yesterday as he is not seeing his daughter (11). She stop coming to us since we moved in to different place and her mom is "supporting" her by not encouraging her to come and visit us (she has to step siblings). Daughter just dont want to travel so far (2h drive) and be away from mother. We tried to reach her by calling to her (she doesnt pick up phone) but nothing. So we went to court. And you know what happened? The court said that the best interest of child is to not see father (and her siblings) as she doesnt feel comfortable and ... they forbid dad to call her as she is anxious whenever she hears the phone. So he can only write letters. Wtf?
Really?! So basically fathers has half of the rights to her daughter but in fact he doesnt have any. He cant even call her and ask her how she is. I think it is not normal.
Anyone knows what to do in this situation?
It would be hard to advise without knowing more about the situation.
How far did u reside from his daughter before you moved? Did you have a court order in place when contact was suddenly stopped?
Are there any safeguarding issues as indirect contact a bit extreme. I do know when your child reaches 10 they start considering their views,wishes and feelings but do have to act with caution when taking them into account. Was there any reasons given apart from 2 hour journey why she don't want to see her father? Mum should be encouraging contact
We were living 15 min away from them now its 2h. And she supposed to spend with us every other weekend. But first time when she came she didnt want to stay overnight as she was missing her mum so we decided that we can see her just few hours but still she wasnt ok. She had some session with psychologist who made a report that she is anxious when the phone rings or someone is knocking to door. They wrote that she needs stability. Oh and apparently she is scared that her dad will abduct her :/
Previously there was no issues she was coming to us we had fun spend time together she was happy.
I just cant believe that the court doesnt consider seeing her father and sibling important. And that he forbid making phone calls.
