Hi all, just wondering if anyone can help me clarify something.
So me and my partner are expecting our first baby together. Now the background is she’s been separated for three years now and we’ve been together just over a year.
The issue is she’s still married and not had a divorce yet - not so much the problem. However I’ve had one or 2 people say to me that because she’s still legally married that automatically makes her ex-husband the step-father of our child.
I’ve always thought step-parent title only applies after marriage following a divorce and it’s starting to stress me out a little.
Can anybody confirm whether or not this situation is technically correct or not.
My understanding is that a step parent is someone who is married to someone with kids and is not their biological parent.
Nothing to do with divorce but you are correct that you are only considered step parent if you get married after the child was born. In your case your child will be born after they separated so no he will not be step parent.
However maybe she should get divorced? There are other issues such as if she dies without getting divorced who does her wealth go to? Without a will it will go to her husband and not you or your child.
