Hi Guys

Sorry not been around was a bit put of by the Changes here.

Well as the title suggests We are going for Committal Those who know the story will know the background.

Child arrangements order has been breached to such a degree that even the School are aware and assisting my Son every way they can.

The order now states Child shall live with his Father x amount of days per week with hand over on a Sunday, The ex has advised her solicitor she wont be handing over due to Childs emotional outbursts at School as he is scared His Daddy will be taking him from School. Son has Checked with School there have been no such things. It seems she is now so used to undermining the court Order she thinks her lies are truth.

School are now very aware of her irrational behaviour and bending over Backwards to help.

The only problem we have now is she turns up at the School when its time for my Son to Collect Child and manipulates the Situation so that the Child is to Scared to go with his Daddy.

The lengths this deranged Woman will go to are bloody unbelievable.

Anybody heard of a Power of Arrest been attached to Order?

If the school are aware of the issue then discuss the option of dad collecting son fifteen minutes before the end of the day by a different entrance. Schools can do this if they are aware of the situation and especially if there is a court order stating dad should be collecting him. It will also mean they avoid a situation between both parents.

Power of Arrest orders are rarely attached which is why these women get away with it, doesn't mean its not worth your son asking. Could try asking SS to intervene and for them to facilitate that hand over.

Hi

The School agreed to a collection of 30mins early unfortunately Mother has backing of her Parents and they sat outside school the whole time my Son was in there.
The Child just states he is scared to go with his Daddy. ( Mothers Influence) .
My son has a shared 50/50 order that is 4 months old that has never been adhered to.
In the last 4 months he has spent a total of 3 nights with his Daddy with no upset (Mothers did not reckon Child would go with his Daddy when he collected him from school and it backfired)
Low and behold solicitors letters advising Child now having Emotional outbursts at School due to staying with his Daddy. School advise this not the case.
In hindsight now wishing we had just made application for Enforcement. Solicitor has advised as applying for variation of existing order will take months as courts will request reports .
Surely if as penal notice attached for immediate imprisonment for non compliance states if she go,s to prison ( long shot we know) then residency would revert to father anyway?
18 months, 15k, 2 court orders a penal notice and still no further forward..

when you say your solicitor has advised you, what was that advice - I'm not clear from your post. I would certainly be looking at enforcing the order as an option with the hope that either it will happen, or that the mother might back down for fear of it being enforced.
