Hi all,I have recently attended a MIAM,I attended alone as my ex wife refused.She has refused mediation even when I have offered to pay her share to sort things out.My question is,if it goes to court and before a judge,what is the protocol,will a judge grant an access order,does she need to attend court for an order to be passed? I'm unsure of the outcomes and forgot to bring it up with my mediator,any help is most appreciated,thank you

Hi MG,

Did the mediator complete the Section 14 of the C100?

Its sadly not as straight forward as that. Courts rarely make orders at a first hearing where a respondent chooses not to attend.

Once you submit a C100 application you will be given a hearing date. CAFCASS will contact you to discuss any concerns. There may be allegations made against you by your ex. Don't worry, that's likely all they will be.
