The saga continues.

Guardian appointed by Court went to school to meet with the child and he point blank refused to meet with her.

Mother wouldn't have been happy that she was not to be informed when meeting was to take place so child would've been instructed by her not to comply.

We are being dictated to by a 10 year old who is carrying out his Mother's wishes.

Guardian says it's going back to Court immediately.

WOW! I'm gobsmacked again. I have never known anything as bad as this. The mother is playing a very dangerous game here.

Hopefully the court will list an urgent hearing to give new directions and something will be done asap.

A 10 year old child should not be scared of speaking to a Guardian at school unless there has been some manipulation by the mother. The court will tire of this eventually and she really should be wising up or she's going to end up losing the child entirely.

The court will have to bring it back asap, I can't see any other option as the Guardian will not be able to complete her report.

My Partner phoned court today to check if a hearing date had been decided in view that we go on holiday for 10 days this weekend. The Clerk said the Judge has the paperwork and is aware of the holiday. He also commented that Mother's solicitor had sent in additional paperwork so we assume this is to vary the final order to nil contact as the Solicitor tried to add this as "issues" at the last court hearing.

Is this really likely to happen or does it just demonstrate further the Mother's reluctance to allow father & child to have a relationship?

Reducing contact to zero is unusual - it would have to be shown that any contact was detrimental to the welfare of a child. The courts generally like to promote contact if they can.

It's been Mother's goal all along to get zero contact. She's just not actually come out and said it. I guess she hopes the Judge will say if child doesn't want contact then it won't happen. Thankfully the Judge has been putting the child's welfare first and realises who is actually at the back of it all.

You have enough evidence of the mother's implacable hostility to contact and most recently, you have the word of the headteacher at the previous school too.

Given the child has refused to meet with the Guardian, this should set alarms bells ringing for the court. A child of 10 should not be scared to meet a Guardian and relay their wishes and feelings unless the mother has tried to influence the child not to. I mean, realistically, how would the child even know who was coming to speak to them and why unless the mother has laid this all out.

It could be suggested that a teacher or the headteacher sits in with the child and the Guardian. The mother can't hide forever and this judge has been good previously.

The teacher was planning to sit in with the child and the Guardian but he still refused.

We certainly need this holiday.

Nothing much to say at this point as its in the hands of the next Court hearing, but wishing you both luck. This has been an absolutely despicable travesty.
