Hi there could anyone tell me the timescale between sending the c79 form and going to court please

from what ive read the enforcement hearings have more priority over the standard hearings. but couldnt give you an exact time span, it usually takes around 6 weeks from submitting a child arrangement application to a first hearing so im hoping it would be quicker than this.

If there has been a clear breach of a contact order then i would not hesitate and apply for enforcement
the sooner you do the quicker the matter can be dealt with, rather than leave it to the off chance that she'll come around, because they never do, if it were that simple then there would be no need for court in first place.!

Im in the position of applying myself as ive had 3 clear breaches in 4 months and one involved blackmail attempt to change the terms of the court order (which i agreed to aswell) so ive tried to be amicable and reasonable for the sake of my son and can prove to the court this, but she still taking the piss so time to let the courts deal with it.

i have 2 personal experiences with a c79 .

first time i took it to court , went to an usher and requested that it be put before a judge that day , within 3 hours i walked out of court with a court order in my hands after an emergency hearin and had another hearing booked for a few days later

second time i also took it to court but this time submited it via the normal chanels and it took roughly 4 days for me to get a court date which was only a couple of days later

alot depends on the circumstances

Hi,

I applied for an enforcement order on Feb 2nd this year and it is still on going. Dont let that scare you though as each case is unique, i have tasks to complete which have a time scale, so when people say enforcement's can be quicker then that is not necessarily true as it all depends on your circumstances.

Enforcement hearings are supposed to be listed within 4 weeks. If you feel it is urgent, you could attend court in person and try your luck for an emergency hearing.

i enquired about an emergency hearing from my local court and was told that emergency appointments are not available for enforcement orders.
there may be an exception if the child was at risk of harm or removed from uk without your knowlege/consent. but thats what i was told on the phone.

when i spoke to court staff they told me they aim to process the application and i should hear within 10 days . i assumed i would be given a court date within 10 days. i suppose its based on location and how busy that court is

Just ask at the front desk and they will usually ask someone from the court office to advise you.

Hi there I went down to court and asked for an emergency enforcement order and they said they cannot do this as the children are not in danger so I've drove over to Leeds court and handed the c79 form in

Is there a compelling reason why it would need to be done quickly as far as the court is concerned? is, something that raises it above the priority of other cases?

Palmer only option I had was to take the forms to Leeds court just to save time in the post. I did try going back to court for an emergency enforcement order but like I said they will only do emergency if the children are in any danger. Other courts might be different you could always try
