Hi guys

So just a little update on what’s been happening. Which mostly so far has been nothing.

I have been giving social service calls almost every day for the last 2 weeks i informed them to call me out of my working hours as I do not get personal calls at work also I’m not allowed to have a phone on my possession at work so I have been missing my lunch to make these calls to social work. All I get from them is your case worker is not at her desk right now i will get her to call you back I then explain that it had to be within my half hour lunch. Then nothing think she has returned my call 3 times during my working hours. So today I phoned on my lunch again was told again she’s not at her desk I’ll get her to phone you back. My frustrations got the better of me and I told the receptionist don’t bother getting her to phone me back I said we have been trying to speak now for 3 weeks and the correspondence from them was terrible that I haven’t seen my son for over 4 weeks and they have barley attempted to contact me I’ve not had one letter from them nothing just a 3 voicemails during my working hours. I told the receptionist that I had seeked legal advice and was dealing with a solicitor and told them to get social worker to just contact my solicitor for any further correspondence because social work are just wasting my time. I also informed my solicitors assistant of this today and she agreed this was not good practice from social services and could understand my frustrations. My solicitors assistant also sent my ex partner a letter almost 2 weeks ago now to ask for contact between me and my son however the solicitor assistant informed me that they have yet to receive a response from my ex partner or a solicitor.

So it’s been 3 weeks more now and I’m no further forward. I had hoped to have dealt with social services and possibly resumed contact with my son after but this has not been the case.

Is this normal for social services to have behaved this way ?

I’m thinking my ex partner has probably fooled social services that much that they aren’t really interested in speaking to me. I would have thought they would have been eager to speak to me and would have acted better and maybe even sent me some sort of correspondence threw a letter but I’ve had absaloutley nothing from them. I only know they wanted to speak to me due to my ex partner passing the number to my mother and telling me to contact them after my mother tried to arrange contact for me and my son.

So see what the next couple of weeks brings hopefully there is some more better developments in my case starting to get a bit stressed with it all now to be honest.

It might be worth contacting the family rights group - they are a charity that can help with Childrens Services matters - www.frg.org.uk

Contact social services and tell them you wish to make a complaint about the social worker, i did this and someone gave mine a kick up his backside

Hi everyone so there has been a few slight developments in my case.

I have had 3 appointments at my solicitors the last couple of weeks for legal aid forms etc I was told this could take possibly 10 weeks or more. Then today I was contacted by my solicitor and was told I had been granted emergency funding until my legal aid is dealt with. My solicitor is now preparing papers for the courts for emergency contact. I’m unsure how this works I did ask about a few things like if I need to attend court etc which I don’t. They said it could be a high chance I will get knocked back for emergency contact once my ex puts her lies across. What happens then do you need to wait to it then goes to hearings at court which I would attend can any of you answer this for me as I forgot to ask that question today. My solicitor said there has been no contact from my ex or a solicitor on her behalf so my soicitor said she will be served with court papers within the next couple of weeks and she has certain amount of time to respond she wasn’t very clear on how long or anything and I didn’t ask was just a quick call I had taken during lunch today. If any of you can advise on the process of what’s happening remember im in Scotland also.

My solicitor also said if I don’t get emergency contact from the court it may force her to arrange contact as she Will know that I’m taking her to court there has been no contact apart from 1 lawyers letter asking for contact so she is unaware any of this is happening just now.

Hi

I'm really sorry, I don't know the legal system in Scotland at all. In England, you're usually looking at a few days to get an urgent hearing & on average 4-6 weeks between regular hearings. Nobody can predict what an individual judge will decide, but your solicitor should have a pretty good idea.
