TOPIC: Help please court process

Help please court process 1 month 3 weeks ago #96983

MOJO thank you ever so much you have been more than kind to me ! . Those resources look excellent I'll be sure to check them out in depth so I can be as ready as i can be before the 4th of Feb.

Is there anyway I can send you some money to get yourself a coffee or a few beers or something? I didn't expect this much help and it's amazed me how kind you have been I would of had to pay alot of money for some of the advice I have received here and i feel like it deserves something back :)

Thanks Yorkie, but there's no need, we're just happy to help! Appreciate the thought though. :)

I'm not a lawyer or barrister and my responses are based on my own opinions or experiences of the family court.

I may not be legally trained... but I have plenty of experience and common sense!

Sorry for the lack of activity I've been very busy at work this week and just not had the time . I'm working on my statement today and hopefully will have it finished by the end of the day . Other than that I think I am ready for the 4th of Feb now so fingers crossed it all goes well . I'll come back and post my experience as it might help others too ! I can only say a massive thank you to everybody that contributed and helped me with this I feel like I'm one step ahead now and not in such a panic! Also the fact nobody judged me with my mental health and anxiety and was supportive is really refreshing ! A special thank you to MOJO who really provided me with some amazing links to tools and templates and videos ! This was priceless information and is a gent !

You guys are awesome !!

That’s fine Yorkie, if you would like someone to look over your statement just drop any of us a PM and I’m sure we’d be happy to oblige.

Glad that the links helped... please do come back and update us, although it wouldn’t surprise me if you have further questions after the hearing on the 4th!

All the best

I have several years experience supporting parents in family proceedings as a McKenzie Friend. I am, however, not a lawyer or barrister and my responses are based on my own opinions or experiences of the family court.

Hey guys reporting back from my court date today!

Didn't quite go how I expected it to but here's the lowdown

I arrived and was made to feel very welcome wasn't half as scary as I thought it might be ! I was given a support person who was there to help guide me the whole process , cafcass was also in attendance long story short we thrashed it out in mediation for over an hour and then had to get the agreement signed off by the judge which took all of 10 mins . I was there for around 3 hours altogether which seemed like forever but was worth it . ..

I now get fortnightly contact with my daughter! And some days in the holidays I am also now entitled to go to parents evenings , school events etc etc so all in all a really good step in the direction, I have to do this for 6 months and then if my ex partner doesn't allow more access I can take it back to court and push for more .

They didn't feel a contact centre would be good for my daughter so i agreed to visitation at her house but I am allowed to take her out when I want which was never allowed before, they also didn't feel a Section 7 was suitable right now as my daughter had expressed anxiety about talking to different people which I am really pleased she didn't have to go through that

So basically a massive thank you to everybody that has helped me on here as I couldn't of done this without you ! I didn't need my statement but it was nice to have it anyways the most important thing for me is that I now get regular contact with my little one . It wasn't exactly what I wanted but I will take what I can get and now I can have a relationship with her again .

I feel very emotionally drained and glad that for now it's all over and I can get on with just being a good dad ! I hope anybody who might be going through anything similar can read this and realise that there is hope! You just have to be yourself and speak the truth. The cafcass lady was very helpful and stopped my ex every time she entered into tit for tat and kept reminding her we are there for my daughter .
If I think of anything else I can add I will add it on later for now I am taking a big breath of fresh air and looking forward to my first visit this weekend! There is going to be 1 spoilt girl and I feel like it's all down To you guys

Ah that is great news and thank you for sharing.

To be honest, most cases go a similar way to how you've described, but it's generally the more extreme cases that you end up reading about on here.

Best of luck with your contact and I hope things can settle and progress for you now.

Thank you YODA really appreciate the input you gave me ! And yes not exactly what I wanted but it's better than what I had and hopefully in 6 months time it will progress even further . The judge stated that if she doesn't let contact progress further I can take it back but mediation must be done first . Does this mean basically I would go through the all the same process again ? I'm hoping that this will be the end of it however I would like to be prepared for the worst scenario too just in case . I'm just happy my little lad will get to have a relationship with his sister now . It really wasn't as bad as expected the cafcass lady was awesome too I read some horror stories on cafcass but I can only praise the lady I had she was excellent at stopping the dumbfounded allegations and turning into about my daughter instead .

... unfortunately it does, but if she won’t agree to progress contact, it will be in the case notes that the judge encouraged a return to court to sort it out. Hopefully it won’t be necessary.

Well done Yorkie, you’ve managed your case so well, took advice on board and have a result that is a good starting point. The important thing is the children, your little boy will be so happy to see her! The future looks good... fingers crossed!

She has been forced to give you contact - see if you can give her an advantage to that, for instance by offering to have him if she wants to go away for a weekend, so something like that. If she can start to get time to herself, she might be more inclined to give you more time as well.
