Hello,

I have a residency order for my son to live with me.

The order states that the mother can have my son 10-6 every Saturday.

I (for a very long time) would like an evening out, and we (partner) have a babysitter that looks after my youngest 2 children. The babysitter was going to pick him up.

My ex is kicking up a fuss saying that he must be returned to me, and I am stating that my son can be picked up by a nominated representative.

Who is right here?

Does it specify in the order that pick ups are with you in attendance?

Is there any reason why you can’t pick him up... to avoid this stand off? Could you perhaps accompany the child minder, but stay in the car?

this sounds like the mother trying to exert some control because she lost that when you gained residency. Do you drop your son off with her, or does she pick him up? Is there anything in the order that states what the pickup arrangements are? If nothing in the order and you are being accomodating to her, then you could start to be less accomodating until she reciprocates.

unless the order specifically states rules that you must always be present when child is in your care, you can do whatever you want as long as child is safe and not being neglected. my ex has my kids. she may leave the kids at her mums while she goes out somewhere. i dont care as long as my kids are safe and happy.
