Hello Dad's and father's,

The court instructed my sons mother to provide a GP report outlining her Mental t health to me today and she has failed to comply, what can I do?

hi,

you can send a reminder to the ex, to send the report. if she has a solicitor/barrister, you should send all communication through him/her. you have another court hearing coming up I assume? if she still has not provided the report, you go to the hearing and let the court know that she has failed to provide it.

Bill has made some good suggestions, but if she has made any allegations about you, I would be careful about contacting her directly, better to go through her solicitor. If that’s not possible, give the court a call and explain that she is late providing a GPs letter, ask if she has filed it with the court and if so, if they can send a copy to you.

If it isn’t forthcoming, you could ask for a return to court for new directions, or deal with it at the next hearing.

As has been said - I wouldn't contact her directly unless you have been litigating with each other throughout the proceedings.

If she has a lawyer, ask them to send you the ordered report.

If neither of the above work - write to the court or deal with it at the next hearing. If she doesn't provide it, the court won't just let it drop.

You could call the court before any of the above and check if it has been filed with them. She might have sent it to them and not realised she has to send a copy to you.

Thank you. Yes she has made allegation, so I thought best not to contact her. I am going to write to court and see what they say.

I have now written to the court asking for new direction and the court to address her mental capacity with regards to parental responsibility.
