Hello,



I submitted c100 for contact arrangment order and made a payment last Wednesday and will need advice on this court journey.

i) When will my ex wife receive the paperwork from the courts?

ii) in the application i put her dad's address as she was living with him. But she moved from there in past 4 days and I don't know her new address. Will this be a problem if paperwork will be served to her dad's address?

when i applied to court, it didnt take long for ex to receive papers. possibly got them 2-3 weeks later. thats courts responsibility.

you putting her dads address is fine. i knew my ex always stays at her mums every weekend. i didnt know her actual address, so i put down her mums address on court papers, and she got them. you should wait 1-2 weeks and try contact her dad and say did court papers arrive? even if you dont contact them, i reckon they will not ignore such papers and will tell your ex about it.

Can't say the family wouldn't ignore it if I'm totally honest. They have been difficult so far so wouldn't put it past them to frustrate and cause delays.

I plan to send my ex a message saying papers should have been received at her family's address by now - when i've receive my paperwork. Will that suffice to show courts she was made aware of it being sent to her dad's house?

I did read on another thread that respondents not returning c7 wasnt a big deal as they should still turn up to court on the date given with the c7 form, not sure how true this is. See link below and read comment by familylawsolicitor on page 3 of thread:

hi,

yep, court papers to her dads address is fine. and send her and her family a message to say they should have arrived. she doesnt tell you her address so theres not much more you can do.

Sorry for the late response, didn't spot this sooner.

Be careful about sending messages to your ex, especially ones saying court papers should be with you shortly or with her parents.

If she so felt inclined to do so (and she could be advised to!) she could contact the police claiming you're harassing her! DO NOT underestimate your ex no matter how well you think you know her you have no idea how she'll react to getting court papers.

I know just how long it took court to accept my application and for court papers to be delivered to my ex....16days! and how do I know that? because the day she received them I got the nastiest barrage of abuse on texts...because I refused to answer the phone to her.
Told her on text to say what she's got to say at the court hearing and to stop contacting me....

Similar thing happened when I submitted enforcement application and paperwork dropped through the letter box.....only that time I got a visit from police saying that I was harassing my ex!
it took me over an hour to prove i wasn't ...showing them court documents, orders, C79 application forms and court hearing date paperwork etc.

Dad-i-d

i'm not legally trained....i'm just a Dad going through hell to see his child grow up and become a decent man and human being.....my goal is simple...to be the father to my child like my father is to me...my hero.

Yep I have considered that. But what other alternative do I have to show courts that I had made her aware of court papers being delivered to her dad's place?

Can she pretend she wasn't made aware of it? What's the consequences of this? Do i then need to do somethung else to make sure she gets it? Can the courts not reasonably expect her dad to forward any mail on to her and thus dismiss any argument by her that she didn't receive it?

What about messaging a member of her family?
