Hi all . As the title suggests am looking for people’s experience of spousal support and what length of support etc a court had ordered . I have 2 kids who will both be full time in school In September and the mother has good earning capacity etc although she’s decided to sit on her backside for the last few years claiming she Can’t find work and work work locally as she’s always worked In London , which I can’t imagine a court sees as a reason

... I don’t have much experience at all, but in these so called enlightened times, you would hope that courts would expect an ex partner to support themselves, if they’re able to.

In my experience they focus on current earnings an not future earnings potential!
They also focus on the length of the marriage and age of the children and who the main carer is.
My only advice is to try and make an agreement without going to court as it is a lottery!

Yeah we already have an agreement but it s very open ended and doesn’t have anything in it to make her return to work .. only the standard it stops when something marries it

Yes my ex wants spousal until children are aged 21 . And they are less than 5 . I have to add at an enormous rate and does not want to claim universal credit. ! Even though she can .
I can’t afford what she wants .
she says she will go to work and wants that on top of child maintenance and going to work . I thought when she returns to work it should stop . No arrangement yet

When she goes back to work .. IF , as like mine spousal is there until the kids grow up or she re marries ,I think you “just” apply to court for a variation as her circumstances have changed

If she can Claim
Benefits , then she can go ahead and do so . My order was by consent and we took those payments into account . Also be careful as I think with u t c coming in they include maintenance as income now from what my mediator said so do look into that

Thanks that’s helpful too to remember variation order . She is taking it to court .
What does u t c mean ?
I know universal credit does take off pound for pound from spousal is that what you mean ?
