I was divorced in France and my divorce documents clearly state that my child maintenance payments are capped at 200 euros / month due to a large property and cash settlement given at the time.
The CMS say that as my ex now lives in England that this is overruled and I have to pay a percentage of my income which is considerably higher.
Myself and my ex wife are British.
Are they correct?
As far as I've been researched and been told by a family solicitor if you both live in the UK then after 13 months of a consent order being granted either party can go to the CMS to get them to calculate child maintenance.
Your best bet is for you not to live in the UK as the CMS can't chase you.
