I have a court order for contact every other weekend and half of the school holidays.
This dates back to 2015.
There is a paragraph which states that by a specific date mum is to provide dad with the kids term dates and "a schedule of dates that she believes are available to the father as contact as per the order"
My ex views this paragraph as an opportunity to set the weekend schedule for the year as she wishes. This involves swapping weekends as she sees fit.
This creates a problem for me in terms of planning my weekends in advance, she swaps one weekend and it effects every weekend that follows.
There is no valid justification presented for the weekend swaps.
I have made it clear that I am happy with one off weekend swaps but have an issue with changes that shift the ongoing pattern. The pattern that is defined in the order.
Can anyone advise on my options to resolve this via the courts as I know from experience that nothing else will work.
i can imagine this being a difficult situation. you can go to your childs school website and get the term dates yourself if your ex is not bothered. to avoid going back to court, you can try and be flexible with the swaps. long as its not affecting your job etc.

The problem is that the alternating weekend cycle which allows me to plan work / kids activities / personal activities etc is disrupted when my ex swaps the weekends and all subsequent weekends are shifted.
Also when the swap itself occurs I'm always the loser i.e. I go 3 weeks without seeing my kids.
It just doesn't seem right that one parent can plan and the other can't - this surely was not the intention of the court order.
An enforcement order seems heavy handed but maybe this is my only option?
have you had any holidays abroad with your kids yet? because if swaps keep on happening, this could ruin your plans big time. if you don't agree to the swaps then it should not be a one-way street like this.
