Hi
Interested to follow how all pans out, depends on the Judge at the time but saying that Cafcas will come to the party late and they will drag, feet, etc

Make sure you get a written statement from them, have a habit of adding and twisting in favour of ex.

Not sure why that is, I was told date via email before docs arrived, when they did it had the same date. Not sure why that is in your case. I would call them tmor and clarify. Are there no dates written on there what so ever? I mean mine is 1st hearing via phone so exactly the same.

In terms of CAFCASS im guessing a date has to be given to them so they can complete whatever before that time. I did get an email from them to confirm my details before me and they can move. An't heard anything since.

Im the not sure on the process of a witness statements but guessing it will be pretty much the same words (copy and pasted) written in the nonmol order, worked for her then so it will work for now. I would work a defence around that order but for the c100 hearing. Dont waste time waiting to get anything from her. Just my opinion.

From what Ive gathered. She'll get a copy of your c100 form, she will have to respond using c7 acknowledgement form and if she ticks boxes 6/7 she has to attach a C1A when returning them. This last form is where she notes down the allegations. Min the courts receive a C1A, the process will not be smooth sailing.

With covid everything is staggeringly slow so for now get on the phone with them.

Would I get a copy of the c7?

I know court would go ahead anyway but I am a bit worried she would just ignore the letters and say she never received anything.

Though I guess cafcass will call her- I don’t have her number so I’m guessing the court’s will find it from the non-mol info they hold.

Updates:... got the email from cafcass and waiting for a call- no date/time confirmed yet

In addition to my questions above, could anyone tell me if I would receive a c1a by post or email? I am anticipating getting one since she got the non-mol.

C7 is just her acknowledgement of your c100 application.

Not sure if you get copies but I haven't received anything from them. Likely the application is only for the courts, so they can decide what next step to take, hopefully someone else may comment and clear this up for you.

In the nonmol order you would have received details of the allegation, not sure if a c1a is completed for nonmol order, so I believe you wont get any more documents in relations to that.

c1a is for c100 purposes.

If she ignores the letters then so be it, dont worry to much about her, focus on your tasks ahead. It wouldn't look to good if she didnt show up but remember she has legal aid so at some point her solicitors will be up there representing her anyways.

Yes Cafcass would have had her details passed on to them through the courts. They will use any information on file to make contact.

Its been a while since I got anything else from Cafcass, no calls in over a month now.

Thanks for reply. I got the non mol without notice so not sure. Return hearing is in August. No hearing date for the c100 (I said above court gave me date on phone but documents state I won’t know until after cafcass checks...)

I assuming c1a will be sent to me somehow if there is one...

UPDATE:

I have had my Cafcass interview which went as expected (I said what I needed to say but obviously they asked me about my criminal record which is from before I had children)

Cafcass informed me the mother had been involved with social services in 2013 for neglect concerns which I never knew, but it doesn't look serious and is not ongoing. Our relationship was on/off so I assume we were not together at this point.

I have been sent a c1A. The allegations are the same as the non-mol and I have strong evidence to prove it is false and her allegations are weak. Luckily the allegations are not awful and she has had her interview so at least she is cooperating... sort of.

Emailed her solicitors for interim contact which was denied, but that was expected.

I think the good news is my non-mol paper hearing was re- listed for a proper hearing. I think I have a good chance to at least get an undertaking, but hope to have it dismissed altogether. I guess court saw that I had evidence to prove her claims were false (at least 2 of them) so are giving me a fair hearing to represent myself.

So now I have 2 hearings coming up (a new proper non-mol phone hearing and the c100 hearing.)

Can anyone share experience of what happens at a non-mol hearing? I have sent my statement and evidence- will the judge just question us both?

Same was not going to be in Debt was advised that the court will always side with the other etc but make sure that you get a good statement undertaking that yourself can accept and push your ex to an undertaking that if not met then your Ex will be in breach of court.
