CAFCASS Safeguarding Letter?

I have had my safeguarding interview with CAFCASS a few weeks back and raised my safeguarding concerns etc

I have been sent a hearing date, but they haven’t sent a copy of the safeguarding letter. I have contacted the court directly and they have said that they won’t be sending it out to either of the parties?

Why would they do this? I want to have scope and challenge anything I don’t agree with on the report in preparation for my hearing.

Thats a new one on me? I don't understand why they have not sent you a copy? Have you called cafcass and asked them to send you one?

Ive contacted CAFCASS and they have said that it’s at the court’s discretion. I’ve contacted the courts and they have said that parties will not receive a copy until the courts decide otherwise?

I need to have scope of it so that I can prepare if there’s anything I want to challenge etc

it seems this has become a common practise now. Cafcass/court decide not to give the safeguarding letter before the hearing. This is because letter may have sensitive information like allegations, and this might cause more hostilities between parents.

But how would this help in preparation for a case? It could affect a case massively

@dadlad Hi how did your case go? I am in the exact same position and have no idea how to prepare. Cafcass said they will not be releasing any info until court date. Did it go in your favour, what happened don the day? feel really lost

I contacted the court via email and requested that I needed scope of the report prior to my hearing and the courts made an order to Cafcass and it was released.

When I received it I went back through it and noted everything I didn’t agree with and then also things that had been completely missed out etc

These can then be addressed at the first hearing.

They always seem to have some control and power by saying the same quoted words: Practice 12J

This always put’s a stall on things.
