I have a hearing for shared parenting on the 30th and I just found out that my 5 year old son will be attending a new school starting TOMORROW. She claims that she cannot afford make the drive to and from everyday during her week despite going out with friends, drinking, etc. We originally agreed to keep him at the school near me because my wife is always home to get him on and off the bus. Her schedule requires her to have an alternative caregiver anyways so she is basically stripping away any time I could be spending with him. She works until 3 AM and I can only assume she's picking him up around this time. I don't understand how she thinks this is best for him. I've considered going for full custody so that he can finally have some consistency in his life. Any feedback would be appreciated.

You will need to bring this up at the hearing on Friday.

If you have parental responsibility then you have a right to have a say in your child's education.

You can ask the judge to accept a verbal application to add a specific issue application within the existing proceedings.

What point in the proceedings are you? Is this a first hearing?

Yes this is the first hearing. Wouldn't a judge want my son to remain where he's been? She is more or less doing all of this because she can.

Possibly yes, but since its now happened, I doubt that the court will order it to revert to the previous school even though it's just happened. Presumably your ex will come up with a half convincing reason for the move . I doubt that you will succeed with full custody as again, the courts tend not to move where a child resides unless there are serious welfare concerns, so I would concentrate non matters other than custody at the moment.

Hi there

I agree with Yoda. I would have said that it might be worth ascertaining when she made the application to change schools, if it was after she received the court paperwork the court would take a dim view of that.
