how can I get my ex wife to pay towards kids if she is claming benefits but wont help me bring them up when she is not allowed to se them by the courts

Hi there

If she is claiming any benefits for the children, such as child benefit, you can contact them and open a new claim to have it paid to you, I would advise that you do that ASAP. You can also contact CMS and open a claim for child maintenance, if she works, you would be entitled to roughly 12% of her gross income.

If you are entitled to housing benefit, you should also let the local council know and you may also claim working tax credits if you work and are on a lower income.

I agree with mojo - open a case with CMS and let them do the work. If you mean she is on benefits (as opposed to child benefit), then she will be assessed at a flat rate of £7 per week, but I think CMS can get that deducted directly from her benefits if she refuses to pay.

if shes just claiming benefits i would leave her alone, but just focus on getting child benefit payments sent to you, if thats possible.
