My recently ex wife has entered into a relationship with my sisters ex husband/my brother in law, and has on many occasions had him around my kids whilst in her care.

The reason i do not want this too happen is because there is a police report on him threatening too harm himself infront of his own kids 2 years ago but also other occasions where friends and had had too talk him out of doing so. There was also a social report done with his kids school because of this

Having said to my ex that i dont agree to him being around my kids several times, she has continued to ignore my request. Can i legally get something in place where he wont be around them, because of his mental stability

Hi there

You do have legal redress, but if you were to take this action, she might be inclined to make contact with your children more difficult for you.

If you’re concerned, you should first contact Social Services and share your concerns with them. I would also speak to the school about it.

The next step would be mediation to try and get her to agree, but if that failed, the mediator would sign the form to enable you to make a court application.

If you felt that your children are at genuine risk of harm, you could bypass mediation by making an urgent application.

The application you can make would be for a Prohibited Steps Order, it would probably be advisable to make an application for a Child Arrangements Order for a shared care arrangement too, this would state that the children live with both of you, so that if there was a serious safeguarding risk at any time, you would be in a position to move quickly to keep the children with you.

If you intend to represent yourself, some solicitors offer a free initial consultation which you might find useful. The court fee to make an application is £215, which is all you would need to pay, if you instruct a solicitor to act for you the cost would be considerably more.

Many thanks. Had came across the Prohibited steps order on a google search and have arranged an appointment with my lawyers to discuss this. I have been to a mediation intake only so far and awaiting appointment dates, as they also said he should not be around my kids because of the police report and his mental stability.
