My ex partner left with my 2 year old son in early April 2019. I still have not had any contact with him since!!!!
The case has gone to court and is falsely citing domestic abuse (not physical but mental).
This IS pure slander but I do not know how I can prove my innocence. I can't contact him or find out anything about his welfare or whereabouts due to her filing a C8. Anyone know how I can prove my innocence?

Hi there

Are you the applicant in your case? The C8 prevents you from knowing their whereabouts but only applies whilst the court case is ongoing.

When allegations are made the courts sometimes decide to have a finding of fact hearing, the allegations are put to the court, along with any evidence, and the judge either finds in favour of the allegations or not, this allows the case to progress.

Yes U am the applicant for the case.
Unfortunately the court has already judged that because of these truly false accusations the I am only allowed to see my son in a supervised contact centre at the minute

Hi there

Courts are increasingly using contact centres and the positive aspect of supervised contact is that a report will be produced by a trained member of staff, if your relationship with your child is good, that will be reflected in the report.

Try not to look at it as a bad thing, it’s a step in the right direction and after a period of time, once the court are reassured, it’s likely that contact will be moved out of supervised contact. It’s a slow process, you will have some hoops to jump through, but your situation should get better, just do all thats asked of you and stay focused on your child.
