Hi can any one adive me on how much it would cost to go to court for parental responsibility and child access as my ex partner keeps changing things around all the time and nothing is consistent

Hi there

It depends whether you use a solictor or not, with a solictor it will cost thousands, without a solictor, the only cost is the court application fee of £215.

Some people decide to do the preliminary steps themselves and use a direct access barrister for the final hearing.

Some use the services of a McKenzie Friend, although it’s important to use one that has been recommended, as they’re an unregulated body.

You would need to attempt mediation before submitting a court application, if the ex is on benefits, you will also get the first session free. If you are both on benefits, you will get legal aid to cover the cost of mediation. An exemption from the court fee can also be applied for where a party receives benefits.

How much will it cost to go through court?
Well that is one of the most difficult question to answer! But I’ll give it a go…
How long is a piece of string?
Have you got unlimited funds to throw at it using barristers?
How likely is your ex to compromise?
How likely is your ex going to see it as you challenging her control over contact with “her” child as she may think?
How likely is she to see sense that it’s in the children’s best interests to be allowed a control free life with both parents parenting them?

Best advice I can offer is... don’t put anything past her, don’t give her any reason to use against you in court…be squeaky clean…no fights/arguments/threats/abuse etc. keep child focussed and don’t slag the ex off.

Before you can apply to court you need to have tried mediation….more cost unless you can get it reduced rates…as Mojo has already said.
The forum here is a great help for assisting with any questions about the process….for filling forms out I’ve recently been told you can speak with the local PSU (public support unit) at court who should be able to help with the forms etc…
If you’re not confident at speaking out in court then Mackenzie friend is the way to go unless you do have unlimited funds in which case get yourself a barrister who specialises in family law.

Thanks for the replys my ex has played me along so much and I always fall to her little mind games this has all started since she at 5 months pregnant said I wasnt the father although I had full involvement since that moment I've spent alot off money I had a DNA test done and as I knew the child was mine her comments were to me that she got what she wanted and that came directly from her shes just evil our daughter was born and she pulled me back in to the mind games by saying alot off stuff making me believe she wanted me I did mess up slightly and lost my temper once I found out a guy offerd to take my 1.5 month old daughter out to just get in my exs knickers at the time I didnt think and i made severe threats to my ex about this guy I'd never lay a finger on my daughter shes my pride and joy and the only person I have that keeps me going it's been quite an emotional and bad experience for my first time becoming a dad she then went and got a non molestatuion order on me which runs out in December I haven't had contact and I dont plan on starting any trouble or any more arguments will the court look at this in my favour as I just want to focus on being a dad I constantly offer surport and ask how shes doing and I always get bits with out my ex asking and keep reseats in case she says I haven't tried I've been in trouble previous with the police but never been charged or convicted and she threw all this down in the court room and in that 15 minuits I didnt have a chance to speak it made me feel that the judge didnt care what I had to say although I have enough evidence off the emotional abuse and things shes been doing to string me along I'm happy my ties are cut from but shes using my daughter and I'm only getting to see her for an hour a week with her mother in a cafe which is so aqward I'm really good with my daughter but I dont feel that her mum is communicating with my ex letting her no how I'm doing with her or what I hand over my family are also struggling and Its not a nice thing to see as my dad hasnt met his first grand child and my mums had 2 hours in 4 months cheers for the replys I'll look in to things that have been mentioned

about court costs. if you will hire barrister then could be anything like £500+
for me i had 3 hearings. £900 per hearing.

Ok thanks who did you use as I've been quoted 2000 per hearing just think the prices I've been told are ridiculous

Hi have a look on the direct access portal for barrister . If you’re case is pretty straight forward as far as these things go you can find a relative junior barrister experienced in your field . I did this , found one 5 years Qualfied for not much money . Do not use solicitors to do anything as they’ll charge you to send emails / docs etc you can easily do yourself

It’s a lot of money for sure but one thing that happens is you have pre hearing talks where you and the ex or you and their representative etc try to reach a deal before you go into the hearing . Don’t know about yours but I don’t see mine being willing to talk to me let alone agree a deal . So hopefully having them talk to someone else ie your barrister will allow an agreement to be reached hopefully saving another hearing and more likely to be what you’re after
