Hi.

I am a litigant in person.

My ex partner has recently changed address. She refuses to tell me where she and my five year old daughter are living.

She has claimed domestic abuse but the Crown Prosecution Service has directed no prosecution on all allegations. Social services have also gave me a glowing report and recommend that I have unsupervised access with my daughter.

My question is how can I serve a summons on my ex partner in relation to child contact proceedings if I do not know her address for the service of a summons?

If I make a child contact application to the court can the court direct that my daughters address be given to the court by HMRC, the Department of Work and Pensions or by Social Services?

My child is on the child protection register for being subjected to confirmed emotional abuse by the mother.

There is no residence order currently in force.

I have no issues with my ex being the resident parent. My issue is my ex has avoided the service of summons in the past and the court directed that the summons was served by first class post.

How can I serve a future summons on my ex if don’t know where she lives?

hi,

as your child is on a protection register, would it be possible for social services to hand a summons over to the mother?

do you know if your ex visits her parents or family home regularly? in my case, she wouldnt tell me where she was staying with the kids. but i knew she always visits her family home every weekend, so i just put that address down on the court papers, and she got it.

Hi there

It’s a tough one, if she is close to her parents you could maybe put their address (if you know it). Or you could call the court and explain that your child is involved with Social Services and ask if you can use them as a point f contact.

If all else fails you can apply for a Seek and Find Order with form C4, on the form you can direct the court to seek the information from the Social Services Department that are Deane with her.

It’s usual for the court to send on the court paperwork directly to the respondent, but if not in your case, you can pay a Process Server to do it for you
