Hi everyone. I've been separated from my wife and not seen my children for 3 months now.my wife made false allegations again of DV. (she did the same to me in 2012, which was NFAd by the police). Last month she took out a non molestation order against me. I've seen her a few times, in the high street, her in the car and me on the pavement.. She's made allegations that I've breached the non molestation order, last month. I've been called in for a police interview in a couple of days time.. This was apparently 5 weeks ago? Me sitting in my car, outside my Doctors having a cigarette, she drove up behind me and I think took pictures on her mobile of me sitting there... I'm at court next week for me Child arrangements order I've submitted. Now I'm worried, this will go against me. I've had my safeguarding call from Caffcas this week and I think it went OK? Thing is my wife, has a history of false allegations, against her old teacher, for sexual assault, her ex husband for sexual assault and DV, then me in 2012, then her affair partner in 2013, she made a statement of rape against him, now in 2019,im accused of DV and cohesive and controlling behaviour... I wish someone would see, shes a long history of this... And on it goes...

Hi Devo,

I have had the same thing. A non-mol put on me (on a no admissions basis and no facts or findings against me) My wife told CAFCASS that I breached the non-molestation order. I knew I hadn't, but if i had, I know I would have been arrested pretty quickly. I went to the police station myself to ask about this, and they have no record of a breach, so it highlights the lies my wife likes to tell.

What is stated in the non-molestation order. Does it say "you cannot call or message her" does it state anything about being x amount of meters away from her? Look at the court order and see if you have breached anything on the list. I mean, it is ridiculous, if you are outside a doctors surgery, and she happens to turn up, that is not your fault. If you are walking down a high street, on your own, and she happens to drive past you? That cannot be held against you surely? I have had to track my own movements with my phone just in case she makes things up.

Hi. Thank you for your reply. My non molestation order states not to be 100 meters of her or the home, not to threaten or intimidate, or instruct others.. Etc.. I've not been to the home, or to her. I've driven by the house a few times as its on a busy main road. Also the police man said I can as long I don't stop outside.. The police rang me 2 weeks ago, and said she has made allegations. I said I will come straight in, they said, no they will call me in a week. Its been 2,and by the time I see them end of this week, it's been 3.. I'm sure tho that if they truly thought I had breached the non mol I would have been arrested weeks ago???

I would imagine the police have not bothered to follow it up. You are right, if you had breached it, they would have arrested you. As long as you are not doing anything stated in the order, then you will have nothing to worry about. You have every right to go to the police station and ask them about details of the breach. You will most likely find that they have no report of this breach hence why you have not heard back from them.
