Hi, I just been forced to go self employed.
Up until last month I was having to pay £650 to my spiteful ex. My daughter is nearly 19 & goes to college 8 hrs a week & that is "full time education" apparently?! So Im
still liable to pay maintenance ( even tho face book posts quite clearly indicate she is working as a waitress )
Cms were not interested when i tried to appeal the amount and gave them that information as they said the mother is still entitled to child benefit so therefor im still to pay.
I simply cant afford to pay that amount any more.
Struggling to pay that amount has put me in debt, credit cards maxed out, rent arrears etc.
Now 2,months in arrears with cms.
As of this week im self employed, my question is how will this effect the maintenance??
How will it be assessed?
How will they collect/enforce?
Thanks in advance.
do you have a limited company? if so you will find that you will be paying less in maintenance, as they look at your net income, after your expenses deducted etc. i suggest you get in touch with an accountant. you should be able to carry on doing direct pay to your ex, through CMS. if they have sense they would only do enforcement collections if your refusing to pay.
when child hits 20 or goes to uni, thats official end date of CMS payments, so not long to go.
on child benefit:
Your Child Benefit stops on 31 August on or after your child’s 16th birthday if they leave education or training. It continues if they stay in approved education or training, but you must tell the Child Benefit Office.
You’ll be sent a letter in your child’s last year at school asking you to confirm their plans.
