hi all dads, fighting a unjust system,,,,,,,, ok need advice asap please,, quick up date, run down, events that lead me here,, ive 1 child who is nearly 4 years old, i fought for almost 2.5 years againts alot of nasty nasty alligaitions against me,, from the woman i loved,,, she ripd my heart out ,, so i had to have dna to prove im dad, jumped though all caffcass bull, supervised ,,, and contact centers ,, finally i get a court order, last oct . and a really crap one,, seeing my child very little, very, and no overnights, anyway jan this year i had a life changing medical condition, and stupidly i stop contact,, thro my ill helth and nasty ex, so then not seen little one for 8 months, ive sent letter asking ex to re state contact with no answer,, what do i do now any advice thankyou all

hi,

well sounds like you had valid reason to pause contact due to ill health. as ex is now refusing contact, she is breaking court order. if she is crazy and unreasonable, then you would have to go back to court. apply for enforcement. do you have a phone number for ex, email?

You can either try to deal with the mother directly or submit a C79 for enforcement.

yoda thanks,, but??? do i have to have yet again mediation, or like you say sub a c79 ps ive tryd contacting the mother ,, nothing as yet,??????

hi,

if shes breaking rules of court order, then you apply for enforcement. for enforcement application, you dont need to waste more time and money on mediation. theres no mediation (proper family mediators) fowhen it comes to enforcement applications.

if you want to change/vary a court order then you would have to go through mediation process again

Hi

As bill said - you don't have to attend mediation in order to apply for enforcement. You just complete a C79 and send this to the court.

A lot of enforcement applications end in a variation anyway.
