Are there any more hearings? I'm not sure what to suggest here, as it does sound as though you've hit a brick wall. If there are any more hearings, then it might be worth using a MacKenzie's friend to prepare as this will be much less expensive than a solicitor or barrister.

I have the final hearing on 13rh December. It did come up as February next year which would have been great because I could have continued not to take them and proven that there is no negative impact to not doing it. But they found an earlier hearing. It's disheartening now as she is now attacking my whole time with the girls just because she wasn't getting her own way. Even her solicitor wasn't prepared. I could potentially lose time with the children based on her obsession and need to punish me.

hi,

this is just ridiculous. maybe you should consider changing barrister/solicitors. a high calibre one would fight this nonsense tooth and nail.

what is your situation with holidays? whats happens if you want to take kids on holidays abroad? what would happen to your ex's stupid extra curricular activities then?

Holidays are a nightmare of negotiations. I have half entitlement to all holidays but has to be on her terms.
I said to the court about the issue of going on holiday either on the weekend and during holidays as if it was ruled I had to take them I would never be able to take my family away. Didn't seem to mean much.
Just received her statement to the court for the final hearing. What she wants is my Sunday nights as girls neglected and have to travel long distances so distressed even though this has been the case of travelling same journey for six years. She also wants me to take the girls to cheerleading every Sunday so that means I have two long journeys in the car with girls and literally have less than four hours of quality time on a Sunday. Also my overnight on a Wednesday every week would involve taking one daughter to cheer class 4-6 with no tea and meaning I would have to find some way of entertaining my other daughter while we wait even during the winter months.
She has managed to paint me as a real shitty father who only thinks of himself.
I make sure I'm here with my girls when I have them as this is important to me whereas my girls tell me mum isn't there during most of the week as she's working and they have to go to their nans meaning someone else has to take them to classes. So even though she wants my time off me she wouldnt even be there.
It's just diabolical.

I'm having the opposite issue.

My son has been playing basketball at weekends for the last 4 years and has reached a good standard, however, my ex often refuses to take him to games when its "her weekend" which really upsets him.

I wouldn't mind if she was doing something amazing with him, but all she does is either take him to her parents, or sit in the house.

over time, probably a lot of resentment will build up in your son, and he will most likely start to favour you over his mum.

That's already started, on sunday he cried because he had to go back to hers that evening, and he has said he would like to spend every weekend with me.

how old is he? if he is 12 and this goes to court, cafcass would really take his feelings/wishes into account and would persuade judges to go with that.

He is 10, but apparently they would still speak to him if they ask for a section 7 report.

You are right, they will still speak to him and assess how "competent" he is to know his own mind.

true. when my S7 report was being done, they interviewed my 5 year old. asked her does she like going to daddy's house. got her and my 2 year old to draw pictures, to spot if anything weird going on.
