I am 19 months into legal battle with my twins mum one of them I see as per the court order the other I haven't seen for 19 month. this is due to parental alienation. The courts have finally after two separate cafcass reports and my third application for enforcement of the order have decided to believe me and escalated the matter to a district judge and appointed a guardian for the children.
MY QUESTION IS
I submitted my position statement at 4pm today to the court cafcass and there mum. but she didn't send me her statement sequentially and I still haven't received as it was ordered by the judge what will happen now??

Probably not much. If mum turns up with a statement tailored to yours, it will be pretty obvious that she has seen yours before writing hers. You will just need to let the court know at the hearing if this is the case or if she doesn't send you a copy at all.

For future reference, if you are ordered to do this again, you could file with court, cafcass and guardian but don't send to the mother unless court have received hers? Have you checked with court to see if she has sent it to them but not to you?

Glad to hear you're being moved up to a judge and getting a guardian. You should see a difference in how the proceedings are handled. Best of luck

They should be on the side of the child, and as far as I am aware, they have helped in the past.

cafcass are also guardians one and the same I found this out recently, the cafcass officer who did the initial report was appointed as the guardian to my dismay as her first report was ripped to shreds by my barrister. worst thing is once you upset them it can cost you everything as they side with the other instantly

many thanks I did see a difference the judge knew the law and was willing to listen. in my case that was good as the guardian who is also the cafcass officer sided with mum completely. this was a misjudgement on her part as she hadn't seen the evidence I provided to get the case put in front of a judge. no disrespect to magistrates but they don't understand the law like a judge and have cost me four separate appearances as they were scared of making a judgment on my kids mum. even though they knew she was lying they were scared as my child is autistic

Hi

Our Caffcass officer is working with the guardian solicitor[ as one]!!

Caffcass officer lied in court and had 3 meetings with mum , so came to court with vengeance against my son , and said nothing about suicide attempts by mum and 5 months affairs etc

now Caffcass officer wants to meet us , grand dad and nanny , to see if we are suitable to supervise our 30 year old son with his daughter!!

court order says he can see his daughter supervised once a month for 2 hours , but they moved and there si no suitable centre near where she lives or a 2 month waiting list .
we will be in our second month of not seeing her .

what are Caffcass all about , trying to ruin Dads!!

hi Dave,

i'm sorry to hear it has been a horrible experience. generally cafcass do a decent job. well in my case anyway. i was fortunate enough to get a down to earth, level-headed one. she insisted to my barrister that issues about holidays abroad/passports should go into the order, to help reduce the chances of me returning to court about it in future.

must it be in a contact centre? if theres no contact centres available, how about hang around in local area. e.g. with one of my daughters, i see her just 1 hour every 2 weeks at present. i sit in a local coffee shop with the kids. theres libraries, play/leisure centres etc
