Morning guys. My wife's solicitor has asked for me to have a section 7 report. I have a pre trial hearing on 15th of January then a 3 day fact finding hearing last 3 days of January. What I need to know is, if a section 7 report is done on me, will this be after the 3 day fact finding hearing? The reason I ask is I'm at month 6 of still not seeing my 4 children. If I have a section 7 report done on me that could take months, so I could be looking at at least a year of not seeing my children. I had my wife's response statement to my statement yesterday, and again it's all been turned round on me. The last paragraph she has put my 5 and 7 year old no longer call me daddy, as they are petrified of me? I've not seen or spoke to them in 6 months. This is now pure parental alienation.. It seems everything is getting worse and the allegations are getting more nasty and below the belt, even her being nasty about me being disabled. It's hurting me beyond belief. Thing is I never saw this side of my wife in all the years we were married.. Yes there were red flags, but I'm weak, and ignored them. All along I think she knew I was staying to ensure our children were safe and stable.. Although now my 11 year old is self harming. Also I've spoken to SS and the early years team to be informed of my children being ill etc, and the schools, as well. It does seem though that the flow of information to me is not good. Could this be due to me having a non molestation order against me??? It just shows you, you really don't know someone even after 14 years of being married.... Thanks for your time and help..
The more details you give about your case the more it mirrors what my partner went and is still going through. So many details the same.
All I can say is that only the judge can order a section 7 if they feel it necessary and it will/should be after the fact finding otherwise the cafcass officer won't have a basis of fact to start from
(not that that stopped the one in my partners case from deciding things based on lies his ex said, regardless of what was agreed in court)
You'll be looking at at least three months for the report to be compiled. I'm sorry it's not better news but that's the appalling length of process in the family court.
Also just reading back over your post mine are similar age to
Your kids . My ex said my kids didn’t want to speak to me and I obv said it’s a lie and In submissions explained how it’s her that stops them etc. .magistrates basically said kids are too young to have their wishes and feelings ascertained . So just keep focusing on the kids and prooving to court you’re not a danger etc to them and the ex will hopefully be found out . If you can afford it get a direct access barrister to represent you and do all the litigation stuff yourself like I did . As it’s a dirty fight by the sound of it . You won’t be able to cross examine your ex but your barrister will . The magsitrates won’t try to question her as hard as your representative. My magristrares were really good but I’ve read some are not . The pre hearings are just administrative so you just make sure everyone had all the papers in order etc so you won’t need a barrister for that
