Hi,

My partner has a son from a previous partner, although he normally lives with his mum mainly, he has been with us for the past month and will probably be with us now for the next 2 weeks with this coronavirus going on.

Is he within his right to stop the maintenance while he remains in our care?

We also have another son who is 1, can he also reduce his payments now?

She rang him saying you need to pay the maintenance still.

hi,

is your partner paying through the child maintenance service? I am and still made my usual payment, though i will not be seeing my kids for however long the schools stay shut.

it is better if he still keeps paying maintenance. if it is a private arrangement, then there is nothing stopping the mother from calling CMS to open a new claim.

yes he is, but surely if hes not in her care for over a month he shouldnt have to pay?

(she has no interest in having him back btw)

hi,

it depends on both parents, and if their up for crazy arguments in this difficult time. if its private arrangement, if he wants to he can suspend payments temporarily. if its permanent and child will not be going back, then really he shouldn't pay.

Hi

It really would depend on both parents meeting a mutual decision during this time that he’s in your care. But failing that...

I would suggest calling the CMS directly and explaining the situation they are really helpful and also you can inform them of your additional child, they can adjust the payments once they have that information and usually a small reduction is applied and the other parent is informed of the ‘payment changes’

Usually maintenance payments should be kept up but it’s worth calling them to see what they can advise
