TOPIC: Ex wants to take daughter out of school for another yea

Ex wants to take daughter out of school for another yea 2 months 1 week ago #108374

Thanks. The court phone this afternoon to take payment some my application is now being processed.

The school rang first thing this morning too. They were under the impression that everyone was onboard with the de-registering and explained that this was a new situation for them (having one parent not consenting), so they phoned the education department at the council to see if anything could be done. Unfortunately not though, as suspected.

I haven't heard from my ex today, and no news is generally good news. So here's hoping my last email to her sunk in overnight and she hasn't gone ahead with her plans. I will see her when I collect my daughter tomorrow, so I am sure she will let me know then if she has. And if she hasn't, I will still go through with the PSO in the hope that something can be put in place to stop her doing things without my consent in the future.

I dont understand how the educational department cant do anything. You have parental rights id write to your Mp advise you have rights and Covids given your ex the impression home schooling is easy and. Ask them to intervien before this idea catches on.

Home schooling is hard i have friends that do it. It is not the same as the homework packs handed out during covid it goes so much deeper.
Id fight it on the basis your ex got a false representation on home schooling.

Insist if she is to be given permission then delay it for 1 year and ask she attends home schooling groups and educates herself on the whole ethos of it.
She will have to prove on a regular basis that she is supplying the education required if she does home school.

The court can make an order to reverse the actions taken by the mother so far. Hopefully you will get a hearing ASAP as it's something that will need to be sorted promptly.
If the court can't get you to both agree at the first hearing, they will ask you to both submit statements laying out what you would like the court to do and why and then they will make the decision for you both.
Best of luck

I have several years experience supporting parents in family proceedings as a McKenzie Friend. I am, however, not a lawyer or barrister and my responses are based on my own opinions or experiences of the family court.

I phoned the school today (last day of term) to find out if my ex went through with de-registering our daughter from school. Thankfully, it looks like my application to court has deterred her from doing anything before at least having a hearing. Just waiting on a date. So now it will be a case of preventing her from doing it come September when the school is open again, and getting something in place that prevents her from making important decisions like this without my consent.
