Can anyone tell me maintenance is taken into consideration when applying for benefits? i pay maintenance via my bank to my ex with no C.S.A. involvement, does she have to declare this to the benefit people?

Hi

I'm Sarah, the Child Maintenance Options consultant. I understand you'd like to know if child maintenance is taken into consideration when applying for benefits.

On 12 April 2010 the law on child maintenance changed. The change means that parents with care, who are on benefits or wish to apply, can keep all of the child maintenance they receive and it will not affect their benefits.

Income Support, Income based Jobseeker’s Allowance or Income-related Employment and Support Allowance
• You don’t have to use the CSA if you don’t want to; you can now set up a Family Arrangement in private instead
• If you do use the CSA to get child maintenance, any money you get from the other parent will be paid to you directly
• If you are a parent with care you can keep all of the child maintenance you receive and it will not affect their benefits
• It is your responsibility to tell Jobcentre Plus how much child maintenance you receive and when you receive it

Council Tax Benefit or Housing Benefit
• Any child maintenance money you receive does not affect Council Tax or Housing Benefit in any way

Tax credit award
• Any child maintenance money you receive does not affect your tax credit award

If you claim Income Support or income-based JSA must tell Jobcentre Plus about any/changes (amount or frequency) to child maintenance payments http://www.direct.gov.uk, Tel No. 0800 055 6688, Textphone 0800 023 4888
