[Solved] caught in never ending CSA circle and need advice

Guys, PLEASE HELP AND ADVISE

Point 1

I have received yet another phone call from the CSA. This time stating that even though after serving 25 years in the Army and my ex wife
signing off through the Court not to touch my pension, the CSA have said they can now claim money direct from my pension and disreguard the court order.

Point 2

my Daughter who turns 20 in January is working part time and attends a 4 hour a week college course. do i still pay after she is 20 or does it stop ?

Hi Bob,

Did your ex sign of from a divorce POV rather than from a child maintanance POV?

The CSA consider earnings including pension that are taxable.

If your in receipt of disbility/medical pension which is considered attributeable to your service then that will be tax exempt and so not included in CSA calculations.

If yours is your service pension for time served then it is taxable and so would be considered for CSA calculation.

Hiya Dave, thanks for your response.

She signed off not to touch my pension as part of the divorce.

My pension is not medical and therefore taxable and hit by CSA

do you know anything about the age it stops ?

As your daughter isn't in full time education ( this equates to 12 hours plus per week) you are not liable to pay maintenance. Maintenance is payable up until the age of 20 if the child is in full time non advanced education.

Should also have mentioned that CSA guidelines state that child maintenance is generally still paid whilst the resident parent is in receipt of Child Benefit, and here's a link to the criteria for receiving Child Benefit payments.

Hi Bob4helen

Thanks for your post, I am William the Child Maintenance Options consultant. You will need to speak to the Child Support Agency (CSA) directly in regards to them taking your pension. Their contact details can be found on any letter they have sent you, or at www.gov.uk/child-maintenance.

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. The definition of full-time education is more than 12 hours a week of study, on a course up to and including A level standard.
