[Solved] Changing a court approved maintenance order?

Hi,
have been paying for my 2 children £500 a month for the last 3 years, an amount slightly higher than the csa estimated amount but agreed by me and rubber stamped by the court when my divorce was sorted. However, am increasingly frustrated by my ex-wife not spending on decent clothing for my children and pleading poverty etc. Is there any way I can go back to the court and get the amount reduced to the csa level and then I have the little extra cash to buy the clothes myself for the children? or, am I stuck with this amount set in stone until the children are at the ages set in the order?

Any help would be gratefully received

Hi there,

How long ago was the court order put in place?

It's my understanding that any court order that covers finances only stands for 12months (unless there was additional clauses written in)

So you may be able to arrange CSA if it's been over 12months. Just ensure you give notice.

It may be worth writing to the court asking them just to ensure.

Darren is correct.

After 12 months, either party can apply to the CSA for an assessment, and that is then binding in respect of CM, and the court order for CM ceases to exist.
