Hi

i split with my ex 3 months ago i currently pay £380 per month towards his childcare costs, do i have to make child maintenanace payments as well? I have used the csa calculator and it says i should be paying £220 a month so i am already paying way beyond this. My ex has increased our sons hours at childminders and expects me to increase my payments to cover this, I cannot afford this. I currently live with family but will be in my own place at end of this month, when this happens i will not be able to afford the £380 i currently pay. we are meeting up this week to try and sort it out but she doesnt seem to want to compromise as weve had some phone discussions around this. I dont want my son to suffer as hes not to blame what can I do. If I continue to pay at this rate i will not be able to pay my bills!! Really worried and its affecting my health... Please can someone advise on what to do?

Kind Regards

Darren

Hi There,

What your paying is fair at the moment and you have used the CSA calculator to work out what it should be, by paying child care you aren't removing your liabilty for csa payments though as they are still due.

As far as paying both you aren't liable to pay csa and child care allowences your ex will need to cover the cost of child care from the csa payment.

If you are able to offer her more then there is nothing stopping you topping up the payments to her.

How have you been making payments for child care so far?

Hi thanks for your reply. I've been paying through child care vouchers. We have had a discussion tonight and she still thinks I should pay more. It's not possible I am at capacity of amount I can pay. I'm at wits end. Everything has been extremely amicable up to now.

Hi there,

It's sad that money always seems to get in the way of being civil.

I would contact the csa and have a chat as to how to move forward.

Did you have any formal agreement to pay child care in place of maintenance?
