[Solved] CSA payments to ex-wife who lives in Australia

Hi,

My ex-wife is emmigrating Australia in the next few weeks with my 15 yearold daughter. Can anyone please give some advice as to wether the payments that I make to her through the CSA wil still have to be paid.

Hi

As far as I am aware, there is a reciprocal arrangement with Australia where the CSA over here collect payments, so I believe that you will have to continue to make payments.

Thank you for your post. I am William the Child Maintenance Options consultant.

The Child Support Agency (CSA) can only deal with an application for child maintenance when both parents and the child live in the UK.

You do have a responsibility to pay child maintenance, so you and your wife could set up a family-based arrangement. This is simply an agreement between the two of you about who will provide what for your daughter. It can include money and other kinds of support, for example providing clothes. A family-based arrangement is not legally binding but it is flexible and can be changed to suit your daughter's needs.
To help you make a family-based arrangement, we have tools and guides that you may find useful on our website at http://www.cmoptions.org.

If a family arrangement is not possible for you, your ex-wife can approach the equivalent of a local magistrates' or county court in Australia to apply for a court order for maintenance to be made. This can then be enforced by the Reciprocal Enforcement of Maintenance Orders (REMO). This is an agreement set up via the British Government, with other countries, to enable parents to receive maintenance when they live abroad.
