Hi, I have been paying CMS since 2012 to my ex partner for my son.
I recently (Last Friday) had a child with my new partner, I understand my CMS payments will reduce - although the stupidity of the calculations mean that it's not reduced to a realistic amount, but that's another conversation.
I rang CMS who said that the payments will change once we start to receive child benefit. This can take up to 12 weeks, so I queried this with the case officer but she was not much help.
My question is, if the application for child benefit takes 12 weeks, will my newly calculated CMS payment amount take this into consideration and backdate to the day my second son was born, or will I be over paying for 3 months?

I don't know for certain but I would have thought not, the new calculation will probably only take effect once the child benefit has started, and CMS don't normally back date.

This is going to be fun, I can't even get an appointment to register the birth for another 40 days. Going to be overpaying for nearly 4 months if child benefit takes 3 to register.
I would certainly advise CMS - I can't see that they shouldn't take notice of the proof of birth (I don't know how it works these days, but presumably there is some sort of certificate that the doctor/midwife issues, so there is proof of birth) - it's certainly worth pushing for the reductions.
