My wife and i seperated about 2 and 1/2 years ago after she told me she to [censored] off cus she didnt love me anymore and would be happy if i found someone else.I was gutted as we had been together for 26 years.I found out that on her friday nights out she had been seeing another guy who she claimed was only a friend.I have been paying maintenance by mutual agreement for our 2 girls,but the eldest has just turned 19 and i told her i would only pay for the youngest.Consiquently she has gone ape [censored] and threatened me with all sorts of claims against me and my new girlfriend.
What can she actually claim.?

Hi Dixie and welcome

In reality, all she can do financially is to ask the CSA to take the case for your remaining child - the basic calculation is 15% of your takehome pay.

Thanks for the reply.I have given her £160 this month as i only take home £14000 a year.I found someone else after she told me to eff off and she has stayed in the house we had and also has my old car which is still in my name.She is basically saying i have committed adultery so will that affect any additional payments.

from a takehome pay of £14k, I reckon your CSA calculation would be £175 per month, with a possible reduction if you have your daughter to stay overnight for more than 52 nights per year.

The reason for the divorce has no bearing whatsoever on the maintenance payments.

Thanks once again.I know her response will be,"i want more".Typical of women in this situation they use the children as pawns,which really angers me.I don't want my kids hurt but i don't want her to live a life of luxury in a situation she created.Forgot to add she is on £40,000 a year which is more than me and my girlfriends combined wage.

Hi Dixie

I'm afraid that her wage is also irrelevant to what you are assessed to pay by the CSA - you could pay less if she agreed to a family based arrangement, but from what you have said, this is unlikely.

Just had a vicious text from my seperated wife.Apparently she is seeing a solicitor and going to claim for £58 a week for our 13yr old daughter.She says she is signing forms for the claim and £58 is the minimum she has been told she can claim against me.Surely this cannot be right as i only take home £14k a year.I have credit card debts and this is going to totally ruin me.I can't afford to pay for legal advice but she has told me a friend of hers is paying her solicitor bill.The [censored]!!!.

Hi

I would contact the CSA yourself and ask them to handle your maintenance - as I said previously, you would be assessed at £40 per week and a court will not override the CSA so your ex would be wasting money on a solicitor. The payments will be assessed from the date the CSA take the case, so stop paying directly when you approach the CSA, or make sure if you do pay directly, that there is a record of your payments.
