Hi - I'm a father of a 10 year old child. I pay a monthly maintenance of £400. This goes up annually by the RPI as per the divorce agreement. My job is doing very badly.... I am a Director of a limited company. I can only afford a minimum salary at best, anywhere from £500 to £1000 a month. Therefore I need to reduce the maintenance. I believe I have to go back to a Judge for this and apply for a reduction plus a new 'dreaded Form E'. I also have to pay for this process. Can you confirm the procedure.... what are my options? An additional note is that I have my daughter every Wednesday afternoon, sleeping over and drop her off at school. I also have her every Saturday, picking her up 9am (inc. Saturday night sleepover) and drop her off Sunday afternoon. I also have her approximately 50% of all holidays.... so on average I have her nearly 3/7ths of a week. Seems to me that I'm paying way over the odds, especially when her mother is earning over £40,000.

Hi Jeff,

Just so you are aware you can approach CMEC to have them calculate your maintenance. Any party is entitled to do this and the CMEC can overrule any Court decision made after December 2003. So if you divorced in 2004 or onwards, you are entitled to make a claim through CMEC for them to assess you on maintenance. I would stress that your salary being self employed would be regularly reviewed so as to ensure you are paying the correct amount.

If you are paying between 40-80% of your salary its worth it imo

Hi Jeff if you are a Limited Company, How do you get paid. Do you employ yourself therefore having a wage slip therefore you are an employee of your company.
