Hi, I’m a separated parent paying child maintenance through CMS (based on a ~£150k salary). The other parent wants to send our Y5 child to private school, but I don’t agree — I prefer state schools and have made that clear.
We have joint parental responsibility but the child currently lives primarily with the other parent. They’ve said they’ll cover fees but have hinted at going to court for a top-up if I don’t contribute.
There’s no court order in place for schooling. My question is: can I be legally required to contribute towards private school fees if I’m already paying CMS and have clearly opposed the private school route?
Any similar experiences or legal insight would be hugely appreciated.
hi, as your paying CMS already, your not legally required to pay more. if she takes private school route, you can claim special expenses for boarding school fees, but don't expect CMS to give you huge reductions in your payments.
if you earn more than £3000 per week, then she can go to court for a top up payments.
