[Solved] Missing my little girl on her Birthday..

Today is my daughters birthday, she is 3 years old today. According to my Court Order for Contact, and I quote: ' In the event that the childs birthday falls on a day when she is in the care of her mother, The Mother shall make the child available for a minimum of 2 hours of contact with the applicant Father'. Unfortunately, although times were agreed with my daughters mother to pick up and drop off today, She decided at the very last minute whilst I was standing at our 'meeting place' that this was no longer convenient for her and she would not be bringing my daughter to me today to celebrate her birthday.. I took the necessary steps to inform the Police, whom of course advised that they could do nothing EVEN THOUGH I had a court order in hand stating that these are the arrangements we are to abide to. I was advised to go to a lawyer and back to court. AGAIN.

Over 6000.00 spent to get a court order in the first place. Utter joke. Complete scandal.

Your only redress is to apply for enforcement I'm afraid.

If the court case was quite recent you could try writing to the judge that signed the order and tell him what is happening and that she is breaching the order continually, and ask if its possible for him to recall the case. It's worth a try.

Otherwise it's court again but you could think about self repping this time. You would need form C79 and it will cost £215 to apply, unless you qualify for an exemption on financial grounds, you would need form Ex160a to do this.
