[Solved] 8YO Wants to live with me

My 8 year old son wants to live with me because he hates his mum. He complains that she hits him and shouts at him all the time. I have confronted her but she denied it at first then admitted she smacks him if he does something really bad... he claims she does more than this and he's not one for lying. I have also asked if he can come and live with me, but she point blank refused. He's been diagnosed with tourettes and is on the autistic spectrum. He also suffers from alopaecia which i believe is linked to the stress of living at home. I dont even know where to start to go about getting custody or a residential order. Any help will be greatfully recieved!

Hi

I would consider having a word with childrens services to see what their opinion is - at the very least, it could put your ex on notice that she can't get away with anything she wishes.

The problem you have is that a court may well be reluctant to grant residence - at 8 years old, cafcass will almost certainlu speak to your son, but the while the court will listen to what he has said, then won't necessarily act on his wishes.
