Hi, I'm Sarah, a Child Maintenance Options consultant.

For the CSA to deal with an application for child maintenance, both parents and the children should live in the UK.
Having said this, the CSA can still help if the parent who is expected to pay child maintenance lives abroad, if they are:

  • working in the service of the crown - for example if they are a civil servant or work within Her Majesty's Diplomatic Service
  • a member of the Armed Forces
  • working for a company that is based and registered in the UK
  • working on secondment for a prescribed body, like a regional health authority or local authority

Since June 2011, countries in the European Union (EU) must enforce:

  • court orders for child maintenance
  • decisions made by the CSA

This means that formal legal arrangements (for example court orders) for regular child maintenance payments can be enforced if any of the following apply:

  • the parent expected to pay child maintenance now lives in the EU and the parent with main day to day care lives in the UK
  • the parent with main day to day care now lives in the EU and the parent expected to pay child maintenance lives in the UK
  • the p arent expected to pay child maintenance has valuable assets located in the EU - for example, property cars or money

EU countries can only make parents who are expected to pay child maintenance pay CSA arrears if the money owed was from when both parents lived in the UK.
